Man Sues Cheyenne Police Over 2011 Shooting

A Laramie County man who was shot and wounded by city police during a traffic stop has filed a federal lawsuit against the city and four officers.

Lawyers for Mathew Carabajal, also known as Mathew Carabajal Jacoby, state in the lawsuit that he suffered brain injuries and other wounds when a Cheyenne policeman shot him with a shotgun in September 2011, when he was 21. Carabajal’s young son was present at the shooting and also is a plaintiff.

Laramie County District Attorney Scott Homar announced in 2011 he wouldn’t file charges in the shooting because Carabajal was driving toward officers.

Carabajal filed his lawsuit Monday in Cheyenne. It seeks damages for civil rights violations and nearly $1.5 million in medical bills.

Lawyers representing both the city and Carabajal declined comment.
